1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 139, 140(3), 74 and 3(5) of the BNS.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that while she was washing clothes near a river bank when petitioner came and on point of pistol took her away by tying dupatta over her eyes. It is further alleged that the victim was taken to Begusarai bus stand from where she was made to board a train and they reached Delhi. In the entire journey her eyes were covered. Thereafter, at Delhi, petitioner made her eat forcefully at point of pistol. It is next alleged that they stayed in Delhi for some time and on 24.11.2024 she received a call from

No.58766 of 2025(2) dt.09-09-2025 2/3 Birpur Police Station on the mobile of the petitioner and out of fear she informed the police that she had gone willingly and would return in two days. Accordingly, she came back on 26.11.2024 and thereafter the instant FIR was instituted alleging that she was kidnapped.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that had the informant been kidnapped in that event her guardian would have instituted an FIR. It is next submitted that the victim herself is alleging that she was kidnapped which casts an aspersion on the case of the prosecution. It is also submitted that the date of occurrence is 21.11.2024 and the FIR came to be instituted on 26.11.2024 i.e. after the victim came back. It is submitted that the FIR has been instituted under parental pressure. It is further submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court

Patna High Court CR. MISC. No.58766 of 2025(2) dt.09-09-2025 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Birpur P.S. Case No. 240 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS.
