Petitioner apprehends his arrest in connection with Arer P. S. case no. 69/2013 registered under sections 307, 379, 323, 324, 325 and other allied sections of the Indian Penal Code. There is allegation against the petitioner that he gave twice farsa blow causing head injury to the informant. Injury report of the informant reveals that he sustained two injuries on his head said to be caused by sharp cutting weapon but both injuries were found simple in nature.
The contention on behalf of the petitioner is that there is case and counter case between the parties and persons from both sides sustained injuries. It is further contended on behalf of the petitioner that co-accused of the counter case have already been admitted to anticipatory bail by a coordinate bench of this court and moreover,
Patna High Court Cr.Misc. No.32267 of 2014 (3) dt.26-03-2015 parties have already compromised the case.
Considering the aforesaid submissions as well as facts and circumstances of the case, particularly, keeping in mind factum of compromise and grant of anticipatory bail to co-accused of counter case, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in Arer P. S. case no. 69/2013 subject to condition as laid down under section 438(2) of the Cr.P.C. shahid (Hemant Kumar Srivastava,J) U T
