The petitioner has renewed his prayer for bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on search of a vehicle 175.875 litres of IMFL was recovered and the petitioner along with one another was taken into custody.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 8.6.2022 (Annexure-1) passed in Cr. Misc. no. 745 of 2022 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner has remained in custody for more than one year since 24.9.2021.

Having heard learned counsel for the parties and taking into consideration the nature of allegations, the liberty granted in the earlier order of rejection dated 8.6.2022 and the petitioner having remained in custody for more than 1 year since 24.9.2021, the petitioner is directed to be enlarged on bail in connection with Gaya Sherghati P.S. Case no. 598 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise Act, Gaya.
