JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 332(C) of 2013 lodged for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

Allegation against the petitioner is that he agreed to sell four bighas of land at the rate of Rs.1.2 lac per bigha and he has taken advance of Rs.1 lac and thereafter neither he returned the money nor executed sale deed.

Submission of learned counsel for the petitioner is that he is still ready to return the money if some reasonable time is granted to him.

Having heard both sides and in the facts and circumstances, this application is disposed of with a direction to the petitioner to surrender before the court below within a period of eight weeks with a Bank Draft of Rs.50,000/- payable to the complainant and on that he will be released on provisional bail for a period of three months by the court below to its own satisfaction and during that period the petitioner will deposit another Bank Draft of Rs.50,000/- payable to the complainant and once the total amount is deposited, his bail bond shall be confirmed. Needless to say that such deposit will be subject to the result of the case and the aforesaid amount shall be released in favour of the complainant on filing an undertaking by the complainant.

With the above observation, this application is disposed of.
