In this case, the petitioner is seeking regular bail in connection with Hajipur Town P.S. Case No. 390 of 2019, registered for the offences punishable under Sections 420, 406, 467, 468, 120(B), 34 of the I.P.C.

As per allegation, co-accused Ravindra Kumar, on the basis of forged and fabricated power of attorney, sold the land of the informant to different persons. This petitioner was also involved in that conspiracy.

The learned counsel for the petitioner has submitted that the petitioner is neither the holder of power of attorney nor he is vendor. Even he is not an attesting witness of the deeds. He

No.59477 of 2022(3) dt.28-04-2023 2/3 has submitted further that on similar ground, co-accused Jay Prakash Rai @ Prakash Rai has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 11309 of 2021. The petitioner is under custody since 24.07.2022. On the other hand, the learned APP Sri J.N. Thakur has opposed the prayer for bail and submitted that the petitioner was also involved in that conspiracy, as the witnesses in paragraph nos. 11, 12, 13 and 14 of the case diary have supported the occurrence.

Considering the above-mentioned facts and circumstances, especially the fact that other co-accused persons have been granted bail, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 390 of 2019, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the
