2. The petitioner is in custody since 23.02.2016 in connection with Alamnagar P.S. Case No. 21 of 2016 for the offences alleged under Sections 302 and 201/34 of the Indian Penal Code.
3. It is submitted that the petitioner has been falsely implicated on mere suspicion and there is no eyewitness to the alleged occurrence. It is further submitted that there is no material whatsoever to connect the petitioner with the alleged offence. There is unexplained delay of two days in instituting the first information report on 22.02.2016 for the alleged occurrence of 20.02.2016. The petitioner claims clean

Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Udakishunganj, District Madhepura in connection with Alamnagar P.S. Case No. 21 of 2016 with additional conditions that one of the bailors will be a close relative of the petitioner; and the petitioner shall remain physically present on each and every date during trial and in the event of failure to do so on three consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the Court concerned.
