JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-08-2016 The present application has been filed for modification of the order dated 24.09.2015 passed in Cr. Misc. No. 45554 of 2015.

Learned counsel for the petitioners confines his prayer only to the extent of extending the period of surrender.

On the grounds mentioned in the modification application, the period of surrender is extended further for a period of three weeks from the date of receipt/production of the copy of this order, provided the petitioners file an affidavit before learned Court below that they have not been made accused in any other case from 24.09.2015 till date and if it is found that they have been made accused in any other case during the aforesaid period, the period of surrender deem not to have been extended.

Patna High Court Cr.Misc. No.31770 of 2016 (2) dt.03-08-2016 2/2 The order dated 24.09.2015 stands modified to the extent indicated above.

Accordingly the modification application is disposed off in connection with Nawada Mufassil P.S. Case No. 69 of 2015, pending in the Court of learned Chief Judicial Magistrate, Nawada.
