The petitioners seek pre-arrest bail in connection with Yogapatti (Sanichari) P.S.Case No. 426 of 2018 registered under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 & 506 of the Indian Penal Code.
Considering the direct and specific allegation of causing injury to the injured persons by iron rod and spear against the petitioner nos. 1. Raj Deo Mahto, 2. Narsing Mahto
Patna High Court Cr.Misc. No.4220 of 2019(2) dt.31-01-2019 2/2 & 4. Basdeo Mahto @ Basudeo Mahto, their application for grant of pre-arrest bail is rejected.
So far as the other three petitioners, namely, Hari Ram Mahto @ Hare Ram Mahto, Lalsa Devi and Madan Mahto are concerned, since there is no specific overt act alleged against them, in the event of arrest or surrender before the court below, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti (Sanichari) P.S.Case No. 426 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
