====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-01-2019 Heard the learned counsel for the petitioners and the State.

The petitioners seek bail in anticipation of their arrest in connection with Yogapatti (Nawalpur) P.S. Case No. 376 of 2017 dated 04.10.2017 instituted for the offences under Sections 341, 323, 324, 379, 354 and 34 of the Indian Penal Code.

The petitioners are alleged to have assaulted the informant and others and an attempt also has been made to outrage the modesty of the female member of the house.

Learned counsel appearing for the petitioners has submitted that the petitioners as well as the

Patna High Court Cr.Misc. No.3048 of 2019(2) dt.23-01-2019 2/2 informant are not only next door neighbours but are agnates. There is a long pending land dispute between them and the allegation, on face of it, is not correct as nobody has received any injury.

Considering the aforestated facts as also the clean antecedents of the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Yogapatti (Nawalpur) P.S. Case No. 376 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
