====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Raxaul Rail P.S. Case No. 03 of 2007, instituted for the offence under Section(s) 328, 379 and 411/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner has not been arrested on spot. There is no recovery from his possession.

From the written report it appears that two persons namely, Ram Janam Ram and Ajay Kumar Mahto were arrested by the G.R.P. Police on the spot. They have taken the name of the petitioner.

Petitioner is in custody since 27.7.2018.

Patna High Court Cr.Misc. No.3287 of 2019(2) dt.30-01-2019 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judege-cum-F.T.C. II, West Champaran at Bettiah, in connection with Raxaul Rail P.S. Case No. 03 of 2007, subject to the condition that both the bailors will be the close relatives of the petitioner.
