JUSTICE AMARESH KUMAR LAL ORAL ORDER 02-02-2015 Heard the learned counsel for the petitioner and the learned counsel for the Economic Offence Unit. The petitioner apprehends his arrest in Special Case No.47/2014 arising out of Economic Offence Unit P.S. Case No.27 of 2014 registered for the offence punishable under Section 385 of the Indian Penal Code and Section 7 of Prevention of Corruption Act. It is submitted that the petitioner has no criminal antecedent.

This application stands disposed of with a liberty to the petitioner to move before the learned Special Judge, Vigilance-II, Patna/ court concerned who will pass the order in view of the direction given by the Hon'ble Supreme Court in the case of Arnesh Kumar vs. State of Bihar & Anr., reported in 2014(3) PLJR 314 (SC).
