JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-02-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kathaiya P.S. Case No. 56 of 2008 registered for the offence under Section-304(B) of the Indian Penal Code. Petitioner Nos. 1, 2 & 3 are; mother-in-law, Gotani and brother-in-law of the deceased respectively. Admittedly, after due investigation, police submitted charge sheet against the husband of the deceased only for the offence under Section-306 of the Indian Penal Code and so far as petitioners are concerned; accusation against them was found untrue.
Taking into consideration the aforesaid facts and
Patna High Court Cr.Misc. No.32716 of 2014 (2) dt.09-02-2015 2/2 circumstances as well as submission of the parties, let the petitioners named above, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Kathaiya P.S. Case No. 56 of 2008 to the satisfaction of Sub Divisional Judicial Magistrate, Muzaffarpur (West) subject to conditions as laid down u/S 438(2) of the Cr. P.C.
