2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 14, 272, 273, 34 of the Indian Penal Code, Section 30(a) of the Bihar Prohibition and Excise Act, Section 20/20 of the N.D.P.S. Act and Sections 25 (1-b)a/26/35 of the Arms Act.

3. After some argument, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned court below within a period of six weeks from today and

Patna High Court CR. MISC. No.64047 of 2023(2) dt.31-10-2023 2/2 prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order considering the fact that the petitioner has been made accused in this case on the basis of confessional statement of co-accused.
