Petitioners apprehend their arrest in a case registered for the offence punishable under Section 406/420 of the Indian Penal Code.

As per the prosecution case, these petitioners cheated the informant to the tune of Rs. 5,00,000/- on the pretext of getting the work done under Nal Jal Scheme on behalf of the informant.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is submitted that petitioners are Proprietors of PND enterprises who deals with bathroom fittings. Petitioners and suppliers and they

Patna High Court CR. MISC. No.65545 of 2022(4) dt.12-05-2023 2/2 supplied the articles and handed over fittings and pipes to the informant on 08/03/2022 and after completion of work, when they demanded money, this false case has been lodged. Petitioners have got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateI, Gaya in connection with Wazirganj PS case No. 369/ 2020, subject to conditions laid down u/s 438(2) of the Cr.
