2. The petitioner apprehends his arrest in a case registered for the offence under Sections 309(6), 109 and 118(1) of B.N.S., 2023.
3. As per F.I.R., prosecution case, in short, is that on 05.08.2024, informant Dipak Kumar was returning home with his bhabhi and niece after getting treatment by GorakhpurThawe Passenger train. When the train stopped at Sasamusa Railway Station, four unknown persons entered into the train and out of them one snatched mobile phone of the informant and started running and meanwhile other accused persons stabbed the informant twice on his back with knife, due to which he got injured and thereafter all the miscreants fled away.

Learned counsel for the petitioner submits that name of the petitioner transpired during the course of investigation, on the basis of confessional statement of the coaccused, which has got no evidentiary value in the eye of law. Except confessional statement, there is no other material to show complicity of the petitioner in the incident. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Gopalganj, in connection with Thawe Rail P.S. Case No. 35 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
