The petitioner seeks bail in connection with Riga P.S. Case No. 62 of 2019 registered for the offences punishable under Sections 272/273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excist (Amendment) Act, 2016.

Learned counsel for the petitioner has submitted that the petitioner has got no criminal antecedent. In instant case, total 171 liters of Nepali liquor was seized from possession of the petitioner.

Considering the fact that the petitioner has no criminal antecedent and having regard to the quantity of 171 liters of

No.55046 of 2019(2) dt.02-09-2019 2/2 Nepali liquor seized, the Court is inclined to grant bail to the petitioner subject to cash deposit of Rs. 25,000/- (twenty five thousand) in the Court below and on deposit of the same, the Court below shall release the petitioner, above named, on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.II, Sitamarhi cum Special Judge, Excise Act, Sitamarh/ concern court in connection with Riga P.S. Case No. 62 of 2019. The cash deposit of Rs. 25,000/- shall abide by the final outcome of the pending criminal case.
