Petitioner retired from the Building Construction Department with effect from 31.07.2018. He prays for his pensionary benefits, including gratuity, commutation of pension, earned leave encashment, General Provident Fund and other retiral benefits. Petitioner was posted in the office of the Executive Engineer, Garden Division, Building Construction Department, Off Bailey Road, Patna, under respondent no. 3, on the post of Mali (Gardener).

Considering the nature of claim made by the petitioner, this writ application is disposed off with a liberty to the petitioner to file a fresh representation before the respondent

Patna High Court CWJC No.600 of 2019(2) dt.10-01-2019 2/2 no. 4, the Executive Engineer, Garden Division, Building Construction Department, Off Bailey Road, Patna, which will be disposed off within a period of four months from the date of filing of such representation. Any amount, due to the petitioner, would be paid within two months thereafter.
