JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 10-08-2018 The present writ petition has been filed for quashing the (Annexure-6 to this writ petition) and commanding the respondent nos. 1, 2, 3 and 6 to not auction the said property mentioned in the newspaper (Hindustan dated 07.05.2010 for auction Mauza Pakri Thana 31 Khesra No. 861, Tauzi No. 5331 Khata No. 201, Area 6 katha.
2. At the very outset, learned counsel for the
Patna High Court CWJC No.17097 of 2010 dt.10-08-2018 respondent-Bank states on instruction that the loan account has since been liquidated during the pendency of the writ petition and the same has now been closed. No amount remains due for payment against the borrowers or the guarantors.
3. Having regard to the statement made on behalf of the Bank and with consent of parties, the writ petition stands disposed of.
