The petitioner apprehends his arrest in a case registered for the offences punishable under Section 7 of the E.C. Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that 1198 quintals of rice and empty bags having mark of State Food Corporation along with an unregistered auto were seized during the raid.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that petitioner is not a PDS dealer and his name is alleged to have been disclosed by the villagers alleging that

Patna High Court CR. MISC. No.68893 of 2022(2) dt.20-12-2022 2/2 godown belongs to him when it is specifically asserted and submitted that the godown does not belong to the petitioner, it is also submitted that petitioner has no concern with the alleged recovered articles.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mojahidpur P.S. Case No. 38 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
