Mr. Atul Chandra, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-07-2022 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. It is a case of assault upon the informant and his brother due to which they sustained injuries by the petitioners and other accused persons.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He

No.68765 of 2021(3) dt.21-07-2022 2/2 further submits that except injury no.1 sustained by injured Nitish Kumar Jha, all injuries sustained by other injured pesons are simple in nature. There is case and counter case between the parties and both parties have sustained injuries as alleged in the separate incident. He further submits that good sense has prevailed between the parties. Petitioners have got clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Biraul, Darbhanga in connection with Biraul P.S. Case No. 110 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
