JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-07-2022 The present writ petition has been filed seeking the following relief:- "(i) For issuance of an appropriate writ/writs, order/orders, direction/directions in the nature of mandamus directing the respondent no. 3 to initiate the encroachment proceedings against the private respondent no. 4 to 16 / encroachers and decide the encroachment case to its logical conclusion within short span of time by removing the encroachment made by encroachers/private respondents over the Chak Khata No. 54, Chak Plot No. 70 and Chak Khata No. 53, Chak Plot No. 248, 138, 154, 155, 156 and 198 situated in village-Babu Ka Bahuara, Thana No. 301, Block-Kochas, District-Rohtas (Sasaram), which is state Govt. Land."

At this stage, the learned counsel for the petitioner seeks liberty on behalf of the petitioner

Patna High Court CWJC No.20615 of 2021(2) dt.21-07-2022 3/3 to approach the Circle Officer, Kochas, DistrictRohtas (Sasaram) i.e. the Respondent No. 3 for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case, the petitioner approaches the Respondent No. 3 by filing appropriate representation within a period of four weeks from today, under the provisions of the Bihar Public Land Encroachment Act, 1956, appropriate action shall be taken, in accordance with law, after hearing the affected parties, if not already taken, within a period of twelve weeks, thereafter.

The writ petition stands disposed of on the aforesaid terms.
