2. The petitioner has prayed for bail in a case registered for the offence punishable under section 379 of the Indian Penal Code.

3. As per allegation in the FIR, some unknown criminals have stolen away the Scorpio car of the informant to which he had parked at his door. It is further alleged that petitioner was apprehended at Chandauli, U.P. while he was sitting inside the alleged stolen car and on search some liquor was recovered.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Only sitting inside the car does not show the involvement of the petitioner in committing theft of alleged vehicle. The petitioner is languishing

Patna High Court CR. MISC. No.62923 of 2024(2) dt.10-09-2024 2/2 in judicial custody since 20.02.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Dehri (Rohtas) in connection with Dehri Town P.S. Case No. 806 of 2023 with following conditions:

(i) The petitioner shall cooperate in the disposal of trial and be available as and when required by the Court. (ii) Before release, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other case except the present one or the case mentioned in para no. 3 of the bail petition, his bail bond shall not be accepted.
