1. Heard learned counsel for the petitioners and the learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 126(2),115(2),118(1),109,125,121(1) (2),132,352(2),3(5) of the B.N.S.
3. The learned counsel for the petitioners submits that the petitioners have antecedent of one case and petitioner no.1 is aged about 71 years and petitioner no.2 is aged about 65 years and is a woman and the informant alleges that while he was enquiring regarding electricity theft in the house of Ajay Rai, son of petitioner, when the accused persons including the
Patna High Court CR. MISC. No.58701 of 2025(2) dt.08-09-2025 2/3 petitioners started abusing and petitioner no.1 along with Pintu started pelting stones causing injury to informant Surendra and Ajay.
4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation is alleged against the petitioner no.2. It is next submitted that since petitioner no.1 is father of Ajay, as such, he has been implicated with a view to coerce Ajay into submission. It is next submitted that for the same occurrence, the police also subsequently instituted an FIR in which the petitioners have been granted the privilege of anticipatory bail application.
5. The learned Additional Public Prosecutor opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the
Patna High Court CR. MISC. No.58701 of 2025(2) dt.08-09-2025 3/3 like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Ahiyapur P. S. Case No.710 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
