The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 326/307/506/34 of the Indian Penal Code, section 27 of the Arms Act and Section 3(2) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. It is alleged that on the eve of 'Holi' co-accused Anil Yadav fired on the informant on the order of his brother Lakhan, the petitioner was also accomplice of assailant Anil Yadav.
It is submitted by learned counsel for the petitioner that for the occurrence of 20.03.2014, the FIR was registered on 24.03.2014 and the accusation of causing injury is not against this petitioner.
Considering the nature of accusation, this Court is not
Patna High Court Cr.Misc. No.20203 of 2015 (2) dt.30-04-2015 2/2 inclined to grant anticipatory bail to the petitioner. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bodh Gaya P.S. Case No. 92 of 2014, pending before the Chief Judicial Magistrate, Gaya and preferably disposed of on the same day. With the above observation, this application is, accordingly, disposed off.
