JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2015 The petitioner is apprehending his arrest in connection with Chakai P.S. Case No. 29 of 2015 for the offences instituted under Sections 467, 468, 471, 419, 420, 406 and 409 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the informant is a member of B.P.L. and due to this reason, in the year 2014-15, his name was listed for constructing Indira Awas in his name under Indira Awas Yojana, bearing his Sl. No. 134 and family I.D. No. is 3796 and Rs. 60,000/- was payable by the government for constructing house which was to be payable by bank account for which Panchayat Supervisor was deputed to open the account in

Patna High Court Cr.Misc. No.20801 of 2015 (2) dt.02-07-2015 - 2 - the bank. The informant then requested to the petitioner who is Supervisor of Panchayat of the informant, the petitioner told him that account has already been opened in the name of his wife and also told him that his wife had already received Rs. 20,000/- for construction of house. The informant denied that his wife has never received the amount. The petitioner told him that the matter would be enquired by him. The informant reported the matter to the B.D.O. upon which he was asked to complaint in writing to the officer-in-charge of the police station.

It has been submitted on behalf of the petitioner that the petitioner has been made accused in the present case due to mistake of fact. It is further submitted that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is ready to deposit amount of Rs. 15,000/- in the court below which shall be subject to final disposal of the case. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the same, the petitioner is directed to deposit amount of Rs. 15,000/- in the court below which shall be subject to final disposal of the case, let the above named petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in

Patna High Court Cr.Misc. No.20801 of 2015 (2) dt.02-07-2015 - 3 - connection with Chakai P.S. Case No. 29 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jamui, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
