JUSTICE AMARESH KUMAR LAL ORAL ORDER 02-02-2015 Heard the learned counsel for the petitioners and the learned counsel for the State.
The petitioners apprehend their arrest in Gopalpur P.S. Case No.63/2013 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.
The allegation against the petitioners is that they along with others have committed the death of the deceased. It is submitted that the petitioners are the husband and brother-in-law of the deceased. There is no allegation of demand of dowry. The petitioners have no criminal antecedent. The learned counsel for the State submits that it appears from the order of the learned Sessions Judge that during investigation, the case has been supported by the witnesses. After investigation,
Patna High Court Cr.Misc. No.32481 of 2014 (2) dt.02-02-2015 2/2 charge sheet has been submitted. The inquest report and the post mortem examination report show that there is multiple injuries on the person of the deceased.
Considering the facts and circumstances of the case, in my opinion, the petitioners do not deserve anticipatory bail. Their prayer is rejected.
