Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 302, 328/34 of IPC.
Allegation against the petitioner and ten others is to have taken the husband of the informant for panchayati. Later on, the informant came to know that her husband was fined Rs.21000/- and he was lying in restless condition in an orchard. Her husband was being taken to the hospital, but in the way he died.
Patna High Court Cr.Misc. No.32549 of 2014 (2) dt.03-02-2015 2/2 It is submitted that the informant is not an eye witness to the occurrence. Only a suspicion has been raised against the petitioner. Later on, after coming to know the correct fact, she has stated that she has named seven accused including the petitioner only on hearsay. The petition to this effect has been filed in the Court of learned Chief Judicial Magistrate.
Considering the facts and circumstances, in case of arrest or surrender within a period of four weeks the above named petitioner will be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in Chakmehsi P. S. Case No. 100 of 2013, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
