2. The petitioner seeks regular bail in connection with Shivnarayanpur P.S. Case No. 83 of 2025 for the offence registered under Section 30 (a) of the Bihar Prohibition & Excise Amendment Act.
3. As per the prosecution case, during vehicle checking total 192 litres illicit wine was recovered from a tractor at Mathura Bazar near NH 80. Petitioner is the driver of the seized vehicle.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner is the driver of the of seized vehicle. He is neither the owner of the seized vehicle nor any concern with the
Patna High Court CR. MISC. No.58096 of 2025(2) dt.04-09-2025 2/2 seized liquor. On the instruction of the owner of the vehicle namely Vipin Yadav, he was driving the said vehicle. Nothing incriminating was recovered from the conscious possession of the petitioner. Petitioner is in jail custody since 17.06.2025, having no criminal antecedent. Petitioner undertakes to cooperate in the trial of the case.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case, the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-XIIcum-Exclusive Court, Special Excise Court-II, Bhagalpur, in connection with Shivnarayanpur P.S. Case No. 83 of 2025. (Sunil Dutta Mishra, J) khushbu/- U T
