While informant, Lal Babu Singh along with Ansarul Mian were on motorcycle in a way to Sikta Bazar and as soon as reached near the house of Deep Prasad, Deep Prasad along with two others came out and forced him to stop motorcycle. As soon as he stopped, all of them began to assault. At that very moment one bolero jeep came wherefrom one person having stick of baseball got down and began to assault. Subsequently thereof, another person came out from the bolero jeep who, on the point of pistol, threatened the others forbidding them to intervene. Another person got down from the jeep who claimed to be Superintendent of Police, Patna, Special Crime Branch and then, both of them began to assault with stick. During course thereof, the first one

Patna High Court Cr.Misc. No.32497 of 2014 (4) dt.02-04-2015 snatched Rs.4000/- and a mobile while the person who was suggesting himself to be Superintendent of Police, Patna, Special Crime Branch, namely, Jai Vikrant snatched away chain, ring. It has further been stated that he became unconscious. After regaining sense he found himself admitted at MJK Hospital, Bettiah.

From the prosecution version as has been disclosed speaks a lot with regard to its authenticity more particularly at the present stage and on account thereof the allegations attributed against the petitioners did not justify prevalence. As such, the petitioner is directed to surrender before the learned lower court with a prayer for bail which the learned lower court will consider favourably in light of observation as made above.

Instant petition is disposed of in terms as indicated above.
