2. The petitioner apprehends arrest in connection with Sherghati (Dobhi) P.S. Case No. 973 of 2022 dated 18.10.2022, instituted for the offence punishable under Sections 341, 323, 342, 307, 504/34 of the Indian Penal Code.
3. As per the F.I.R., the allegation against the petitioner is that the petitioner along with other accused came armed with lathi-danda, iron rod and assaulted the informant and his brother on the head with the intention to kill them due to which he sustained various severe injuries on head and other parts of the body. It is further alleged that co-accused, namely, Shashi Kumar snatched golden locket from the
Patna High Court CR. MISC. No.61008 of 2023(2) dt.11-10-2023 2/3 possession of the informant's brother, namely, Bablu Kumar.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It is submitted that the petitioner and informant are co-villagers and next door neighbors and some dispute is going on between them. There is case and counter case among the parties. It is further submitted that the petitioner's side has filed an F.I.R. vide Sherghati (Dobhi) P.S. Case No. 1073 of 2022 registered for the offences punishable under Section 341, 323, 342, 307, 354, 379 and 34 of the Indian Penal Code and 27 of the Arms Act. It is further submitted that there is general and omnibus allegation levelled against the petitioner. As per the injury report of the informant and his brother filed by the Investigating Officer, no case is made out against the petitioner for the offences under Section 307 of the Indian Penal Code. Lastly, it has been submitted that he has no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period

Case No. 973 of 2022, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st Sherghati, Gaya, subject to condition as laid down under Section 438(2) of the Cr.P.C.
