In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 341, 224, 353, 323 and 504/34 of the I.P.C.

The informant along with police personnel raided the house of accused Santosh Kumar Singh who was accused in Sonepur P.S. Case No. 57 of 2014 and arrested him and then the petitioner and other family members surrounded the police personnel, abused them and assaulted and tried to rescue accused Santosh Kumar Singh and thereby caused obstruction in performing the official duty.

Submission is of false implication due to petition filed

Patna High Court Cr.Misc. No.21149 of 2015 (2) dt.23-07-2015 2/2 against the informant before the S.P. No injury has been caused to any of the police personnel. Against other co-accused final form has been submitted and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes. Considering the allegation that the petitioner resisted the police party and the informant and tried to rescue the apprehended accused and as such finding it not a fit case for prearrest bail, prayer for pre-arrest bail of the petitioner stands rejected in connection with Sonepur P.S. Case No. 425 of 2014 pending in the court of C.J.M. Saran.
