The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.06.2021, charge-sheet has been submitted in the case and has antecedent of three cases and the informant alleges that he was intercepted by three unknown criminals who looted his motorcycle and his mobile. Learned counsel for the petitioner submits that the F.I.R. was against unknown, the petitioner came to be arrested in Madhaurah P.S. Case No. 36 of 2021 and was made to confess his participation in the present occurrence and in other

Patna High Court CR. MISC. No.70899 of 2021(2) dt.05-05-2022 2/2 two cases, as mentioned at paragraph '3' of the bail application, the learned counsel submits that the petitioner was never put on TIP nor recovery of any incriminating article was made from his possession.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 14.06.2021, charge-sheet has been submitted in the case, he was never put on TIP, nor any recovery was made from his possession and he was made to confess his crime in the present occurrence, as aforesaid, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Madhaurah P.S.
