Mr.Kumar Ranjit Ranjan ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 11-12-2023 Heard learned counsel for the petitioner, informant and learned A.P.P appearing on behalf of the State.

The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

It is a case of commission of murder of the son of the informant by all the F.I.R named accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is a teacher

Patna High Court CR. MISC. No.61157 of 2023(3) dt.11-12-2023 2/3 in the said school and he used to reside in a rented house which was 3 kilometer away from the school. He was not present at the time of occurrence. The residential school was run under the guidance and direction of co-accused Dinesh Singh and his wife Pushpa Devi who were organizer of the said school. Said Pushpa Devi was granted bail by a coordinate Bench of this Court vide order dated 18.10.2017 passed in Cr. Misc. No. 43291 of 2017. The petitioner is languishing in custody since 25.12.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In contra, learned counsel appearing on behalf of the informant and learned A.P.P appearing on behalf of the State have vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court CR. MISC. No.61157 of 2023(3) dt.11-12-2023 3/3 (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-XIX, Rohtas at Sasaram in connection with Dinara P.S. Case No. 39 of 2017.
