The petitioner seeks bail in a case registered for the offence punishable under Sections 30 (a), 38(i) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 40 litres of Mahua wine was seized. Petitioner is in judicial custody since 26.06.2019.
Considering the fact that the petitioner has no criminal antecedent and having regard to the quantity of liquor seized, the Court is inclined to grant bail to the petitioner subject to cash deposit of Rs. 25,000/- (twenty five thousand) in the Court below and on deposit of the same, the court below shall release
Patna High Court CR. MISC. No.55428 of 2019(2) dt.02-09-2019 2/2 the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge-cum-Special Court, Excise, Bhagalpur in connection with Dholbajja (Kadwa) Police Station Case No. 13 of 2019.
The cash deposit of Rs. 25,000/- shall abide by the final outcome of the pending criminal case.
