2. The petitioner apprehends his arrest in connection with Bahadurpur P.S. Case No. 395/2022 registered for the offence punishable under Sections 272/273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
3. There is recovery of 26 litres of countrymade liquor. The petitioner was not caught with the liquor on the spot.
4. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.
5. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks
Patna High Court CR. MISC. No.62775 of 2024(2) dt.04-09-2024 2/2 from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge -1st, Excise Act, Darbhanga/ concerned court in connection with Bahadurpur P.S. Case No. 395/2022, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
6. The petitioner is directed to mark his attendance in Bahadurpur police station on 1st Sunday of every month. Failure to do so, will result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Saif/- U T
