JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 22-12-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for offence punishable u/s 341, 323, 354(B), 504, 506, 324, 498(A), 494/34 of IPC.
Allegedly, the accused persons named in F.I.R. including the petitioner tortured upon the informant for dowry. Petitioner is said to have solemnized second marriage with Kanji Fatma. When he was asked about his second marriage, he assaulted her brother with dab.
It is submitted by learned counsel for the petitioner that
Patna High Court CR. MISC. No.58920 of 2022(2) dt.22-12-2022 2/3 petitioner is husband of the informant. He is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. He is ready to keep her with full dignity and affection as his wife if she will become ready to live with the petitioner as his wife. The informant denied to live in the culture of the family of the petitioner and after sometime of the marriage she made pressure upon the petitioner for living separate from his parents but the petitioner denied to do so, as a result of which the family dispute arose and merely on the basis of the concocted story, the petitioner and his family became named accused in three FIRs. There is mutual settlement between the parties.
Petitioner has two criminal antecedents. Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, since there is mutual settlement between the parties, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.
