The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 427, 452, 307 and 120B of the Indian Penal Code, Section 27 of the Arms Act and Sections 3/4/5 of the Explosive Act.

It is a case of assaulting and recovery of some arms and explosive substance.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner is not named in the FIR and similarly situated co-accused has been granted anticipatory bail

Patna High Court CR. MISC. No.70342 of 2021(2) dt.20-07-2022 2/2 by a Co-ordinate Bench of this Court passed in Cr. Misc. No.65394 of 2021.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur in connection with Vishwavidyalaya P.S. Case No. 31 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
