Though the present writ petition has been filed for quashing the order dated 19.9.2017 passed by the Divisional Commissioner, Patna in Arms Appeal No. 685/2013 as also the order dated 19.6.2013 passed by the District Magistrate, Bhojpur at Ara, cancelling the arms license of the petitioner, however, it is the submission of the learned counsel for the petitioner that the only reason for cancelling the arms license of the petitioner was pendency of a criminal case against the petitioner bearing Shahpur (Barohanpur) P.S. Case No. 175 of 2006, nonetheless, it is submitted that the petitioner has now

Patna High Court CWJC No.14028 of 2024(2) dt.21-09-2024 2/2 been acquitted of the said case by a judgment dated 24.6.2019 passed by the learned court of Additional Sessions Judge-XIII, Bhojpur at Ara, hence, the petitioner be granted liberty to approach the District Arms Magistrate, Bhojpur at Ara for renewal of the arms license of the petitioner. Liberty, so sought, is granted.

2. It is needless to state that in case, appropriate petition is filed within a period of six weeks from today, appropriate decision thereon shall be taken by the District Magistrate, Bhojpur at Ara within a period of eight weeks, thereafter.

3. The writ petition stands disposed of on the aforesaid terms.
