Mr.Sunil Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-09-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 379, 411, 504, 354(B), 506/34 of the Indian Penal Code.
3. As per prosecution case, on 28.08.2023, co-accused Raja Mandal was caught red-handed committing theft in the shop of informant and thereafter, informant brought Raja Mandal before the local people, where Raja Mandal accepted his guilt and returned articles of Rs.35,000/- and also stated that

Thereafter villagers sent informant's mother Rekha Devi, Chhotu Mandal to the house of Adesh Mandal along with Raja Mandal for recovery of theft articles, where co-accused Sobhit Mandal and these petitioners abused and assaulted them.
4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Police, after investigation, submitted final form against these petitioners, however, differing with the same, learned Court below took cognizance. Allegation of assault is general and omnibus. Petitioners are ladies and have got clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the fact that there is general and omnibus allegation and the fact that petitioners are ladies, having clean antecedent, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Biraul, Darbhanga in connection with Jamalpur (Bargaon O.P.) P.S. Case No. 112 of 2023, subject to condition as laid
