JUSTICE SATYAVRAT VERMA ORAL ORDER 25-02-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek regular bail in connection with Sahebganj P.S. Case No. 371 of 2021 instituted for the offences under Sections 272, 273/34 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioners submits that the petitioners are in custody since 12.08.2021, charge-sheet has been submitted in this case and have antecedent of three cases. Allegation is of recovery of 1732.320 litre of liquor and 725 litre of beer from the school.

No.70610 of 2021(2) dt.25-02-2022 2/2 Learned counsel for the petitioners submits that the petitioners were not arrested from the spot and name of the petitioners was disclosed by the local Chokidar and the police based on their antecedent falsely implicated the petitioners in the present case.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody, charge-sheet has been submitted and were not arrested from the spot, let the petitioners above named be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Sahebganj P.S.
