21-08-2018 Heard learned counsel for the petitioner and learned counsel representing the Bihar State Construction Corporation Limited.

Learned counsel representing the Bihar State Construction Corporation Limited has informed this court that the order dated 17.07.2009 in CWJC No. 6317/2009 was passed in terms of the order passed in CWJC No. 6821/2009 and analogous cases disposed of on 23.06.2009 and CWJC No. 8046/2009 disposed of on 16.07.2009. It is submitted that the orders passed in the said CWJC No. 6821/2009 was challenged in Letters Patent

Patna High Court MJC No.2302 of 2016 (3) dt.21-08-2018 Appeal and the same has been allowed by Hon'ble Division Bench of this Court. A copy of the order passed in some of the Letters Patent Appeals has been brought on record as Annexure-A to the show cause.

In the aforesaid view of the matter, it is submitted that now the contempt application cannot proceed. This court would agree with the submission of learned counsel representing the State.
