JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 22-05-2015 The petitioner apprehends his arrest in Turkaulia (Banjaria) P.S. Case No.410 of 2012 instituted under Section365/34 of the Indian Penal Code. It is alleged that the petitioner along with three others kidnapped Nandlal Sahani, the son of the informant.
Subsequently, the said Nandlal was released. Thereafter, he was examined under Section-164 Cr.P.C. in which he has given details that as to how he was kidnapped, how he was taken from one place to another place and how the money was demanded. Ultimately, he managed to escape.
On behalf of the petitioner, it is stated that all this is false story set up for the reason that this Nandlal Sahani used to stay at Himachal Pradesh along with one Abhilakh Sahani. It appears that while Nandlal Sahani was staying at Himachal Pradesh, he enticed away the daughter of Abhilakh Sahani and
Patna High Court Cr.Misc. No.32627 of 2014 (04) dt.22-05-2015 2/2 brought her to Motihari. Abhilakh Sahani immediately lodged a first information report being Karsog P.S. Case No.100 of 2012 on 20.06.2012, pursuant to which police came and recovered the girl and took her back to Himachal Pradesh. It is in retaliation to this the present case was lodged on 26.07.2012 showing that Nandlal Sahani had been kidnapped by the petitioner who happens to be the brother of the informant.
Be that as it may, in the event of arrest or surrender within four weeks from today, the petitioner, namely, Dasai Sahani, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkaulia (Banjaria) P.S. Case No.410 of 2012, subject to all conditions as laid down in Section-438(2) of the Criminal Procedure Code. (Navaniti Prasad Singh, J.) Trivedi/- U T
