1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner apprehends his arrest in connection with Udwant Nagar P.S. Case No. 134 of 2023 registered under Sections 366(A) and 34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to personal grudge, dirty village politics and ulterior motive. Further submission is that the victim girl in her statement recorded under Section 164 of the Cr.P.C. stated that she has already solemnized her marriage with the petitioner but her parents wanted to marry her somewhere else, so she fled away from her home by her own will and she has clearly stated that no one abducted or

Patna High Court CR. MISC. No.60727 of 2023(2) dt.16-10-2023 2/2 kidnapped her. She wants to live with her husband/petitioner not with her parents. The petitioner has got no criminal antecedent.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwant Nagar P.S. Case No. 134 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
