Petitioners apprehend arrest in connection with Warsaliganj P.S. Case No. 184/14 for offences alleged under Sections 467, 468, 471, 472 and 420 of the Indian Penal Code. The prosecution case, as lodged by the informant, is that on secret information informant along with police personnel reached near Warsaliganj A.T.M. where one person after withdrawing the money from A.T.M. was coming out. After seeing the police personnel he started fleeing away but was apprehended by the police and disclosed his name as Chandan Kumar.

No.33854 of 2016 (2) dt.24-08-2016 2/3 It has been submitted by the learned counsel for the petitioners that they are innocent and have been falsely implicated in the aforesaid case. He submits that they are not named in the First Information Report and only co-accused Chandan Kumar was apprehended with the ATM card and money. He further submits that during investigation as well as in the statement of the apprehended co-accused Chandan Kumar the name of the petitioners has surfaced. He further submits that the petitioners are not involved in the fake scheme of "Chehra Pahchano and Inam Pao" and have no criminal history, as is evident from paragraph 3 of this petition.
However, learned APP for the State submits that the petitioners' name surfaced during investigation, hence, opposes the prayer for bail.
Be that as it may, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Warsaliganj P.S. Case No. 184/14, subject to the conditions as laid down under Section 438(2) Cr.P.C. However, it is made clear that the

No.33854 of 2016 (2) dt.24-08-2016 3/3 petitioners will cooperate with the investigation and appear before the police/court as and when required and failure to appear on two consecutive dates without assigning any reason will entail cancellation of their bail bonds without being prejudiced with this order.
