Petitioner seeks regular bail in a case registered for the offence punishable under Section 354(B), 506/34 of the Indian Penal Code and u/s 4/8 of POCSO Act.

As per the prosecution case, this petitioner along with other accused persons forcibly tried to pull the informant in a vehicle and on protest they tore her frock.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The victim in her statement u/s 164 of the Cr. P. C. has not taken the name of this petitioner and the Medical Board has assessed her age to be 18-19 years. Petitioner claims clean antecedent and is in custody since 01.11.2021 and investigation in this case is complete.

Considering the facts of the case, the statement of victim recorded u/s 164 of the Cr. P. C. and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VII-cum- Special Judge, East Champaran, Motihari in connection with Patahi PS case No. 210/2020.
