The petitioners seek Anticipatory bail in connection with Kumarkhand P.S. Case No. 30 of 2019 registered under Sections 341, 323, 307, 427, 504 and 34 of the Indian Penal Code.

Informant in his written complaint has alleged that on 18.02.2019 at about 2:00 PM the staffs of the department were installing boring at his door, meanwhile, FIR named accused variously armed came there and started abusing him and also started firing. Allegation is against accused Ratandev Yadav of causing firing upon him but it missed him thereafter further

Patna High Court CR. MISC. No.56811 of 2019(3) dt.16-11-2019 2/2 allegation is against Anil Yadav and Vijay Roy of firing on the son of informant Pankaj Kumar but those also missed the target. Further allegation is against accused Om Prakash Yadav and Ghanshyam Yadav of assaulting the driver of the vehicle and threatened them to remove the boring machine. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioners named above in the event of arrest or surrender before the court below within four weeks from today, petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No. 30 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
