JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioner, Vigilance and the State.

The petitioner being the Purchase Officer of the Paddy Procurement Centre is languishing in custody since 04.03.2015 in a case registered for the offences punishable under sections 7/13(2) read with section 13(1)(D) of the Prevention of Corruption Act.

It is alleged that the petitioner demanded Rs.30,000/- for releasing fund for payment to the farmers from whom the paddy was procured and ultimately the deal was negotiated for Rs.28,000/- but the petitioner was trapped while accepting illegal gratification of Rs.30,000/-. It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.22247 of 2015 (2) dt.07-07-2015 2/2 that the petitioner has no authority either to sanction or to release the money as the authority lies with the District Manager, Bihar State Food Corporation. Moreover, the investigation has already concluded.

Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance-1, Patna in connection with Special Case No. 11 of 2015 arising out of Vigilance P.S. Case No.19 of 2015.
