The petitioner seeks regular bail in connection with Sonvarsha Raj (Kashnagar OP) PS case no. 67 of 2019 instituted for the offence punishable under Section 395 of Indian Penal Code.

The allegation is regarding unknown miscreants having arrived at the petrol pump in question and snatched cash money as also having looted engine oil and mobile phones. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case, inasmuch as no recovery of any cash or engine oil has been made from the petitioner, however only one mobile has been recovered which is personal mobile. Patna High Court CR. MISC. No.56768 of 2019(2) dt.01-10-2019 2/2 submitted that the petitioner is an accused in one other case but he is on bail in the said case. The petitioner is said to be languishing in custody since 27.05.2019.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sonvarsha Raj (Kashnagar OP) PS case no. 67 of 2019.
