Petitioners of both the applications are accused in connection with Barari P.S. Case No. 49 of 2015 registered under Sections 394 and 120(B) of the I.P.C. Therefore, both applications are being heard together and disposed of by this order. Learned counsel appearing on behalf of the petitioners submits that petitioners are not named in the F.I.R. In course of investigation, their name has come in the confessional
Patna High Court Cr.Misc. No.21083 of 2015 (4) dt.16-09-2015 2/2 statement of Raman Paswan. It is also submitted that it would appear from the paragraph no. 146 of the case diary that informant has refused to identify the petitioners and no any incriminating article has been recovered from the possession of the petitioners. It is further submitted that petitioners are in custody since 26.03.2015 and 18.03.2015 respectively, having no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Katihar in connection with Barari P.S. Case No. 49 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
