2. In this case, the petitioners are seeking regular bail in connection with Mabbi P.S. Case No. 35 of 2024, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2022.
3. As per allegation, 373.8 liters of illicit foreign liquor was recovered from a truck, to which petitioner no. 1 is driver and both the petitioners were arrested at the spot.
4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from their
Patna High Court CR. MISC. No.63014 of 2024(2) dt.10-09-2024 2/2 conscious possession and they are under custody since 15.07.2024.
5. Considering the above-mentioned facts and circumstances as well as the clean antecedent, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Special Judge 1st (Excise Act), Darbhanga in connection with Mabbi P.S. Case No. 35 of 2024, subject to the following condition:- (i) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
(ii) Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioners and if it is found that they are involved in any other case of similar nature except the present one, their bail bond shall not be accepted.
